Terms & Conditions
Scope and Parties

These Terms and Conditions for Long-Term Stays ("Terms") govern all bookings and stays at the J-Relax & Enjoy apartment in Cebu for a minimum stay of three (3) consecutive months.

By submitting a booking request, paying a deposit, or checking in, you (the "Guest") agree to be bound by these Terms.

These Terms form an agreement between:
  • the Guest, meaning the person making the booking and any additional registered occupants, and
  • the Host, J-Relax & Enjoy, as the provider of the long-term rental apartment.

These Terms apply in addition to any information provided on our website, booking confirmations, and house rules displayed in or around the apartment. In case of inconsistencies, these Terms will prevail, unless we expressly agree otherwise in writing.         
Booking Process and Minimum Stay

You can request a long-term stay via our website by email or via the contact options listed on the Contact page.

To process your request, we will need your full name, intended check-in and check-out dates, number of guests, and any relevant information about your stay (for example, if you work from home).

The minimum stay for long-term bookings is three (3) consecutive months. Stays may be extended, subject to availability, up  to several years.

Because this is a private apartment, we generally require around three (3) days lead time before arrival in order to prepare the apartment. Shorter notice may be possible by arrangement but cannot be guaranteed.

Your booking is considered confirmed once:
  • we have sent you a written booking confirmation (for example by email), and
  • we have received the required advance and security deposits within the agreed time.
If  the requested payment is not received on time, we reserve the right to cancel the provisional booking and offer the apartment to other guests.
Cancellations and Changes

Because we focus on long-term stays, cancellations and changes have a significant impact on availability and planning.

Before arrival:
  • If you cancel more than thirty (30) days before the agreed check-in date, we will refund any security deposit paid. The advance deposit may be refunded in whole or in part at our discretion, depending on whether we can rebook the period.
  • If you cancel thirty (30) days or less before the agreed check-in date, the advance deposit is non-refundable. The security deposit will be refunded.

After arrival and during your stay:
  • If you decide to shorten your stay after check-in, you remain responsible for rent up to the end of the agreed minimum rental period, unless we can reasonably rebook part of the period. Any refund for unused nights  is at our reasonable discretion.
  • Date changes, such as shifting the arrival or departure date, are subject to availability and must be  agreed with us in writing. Different prices may apply if the length of stay changes.

Nothing in this section affects any mandatory rights you may have under applicable law.
Use of the Apartment and House Rules

The apartment is provided for residential use only and is suitable for up to two (2) registered guests. Subletting, assigning the agreement, or using the apartment for commercial events or parties is not permitted without our prior written consent.

To ensure a pleasant environment for all residents in J-Tower Residences, the following key house rules apply:

  • No smoking of any kind is allowed inside the apartment or in any internal building areas.
  • No pets are allowed in the apartment.
  • Please respect your neighbours by keeping noise to a reasonable level at all times, especially during the evening and at night.
  • Please treat the furnishings, equipment, and building facilities with care and report any damage or malfunction to us as soon as possible.

Check-in  is by arrangement with us, taking into account your arrival time and  building procedures. Standard check-out time is 12:00 PM (noon) on the agreed departure date, unless we have confirmed a different time in writing.

Guests must follow all building and condominium rules issued by the administration of J-Tower Residences. Where there is any conflict between our house rules and building regulations, the stricter rule will apply to ensure safety and respect for other residents.         
Guest Obligations and Liability

During your stay, you agree to:

  • Pay the agreed rent on time and in the agreed manner.
  • Pay for your own consumption of water, electricity, and any other chargeable utilities or services, according to the meters or building  billing.
  • Keep the apartment reasonably clean and tidy and use all appliances and furniture properly.
  • Immediately notify us of any damage, defect, or safety issue in the apartment or its equipment.
  • Ensure that only registered guests stay overnight in the apartment and that you do not exceed the maximum of two (2) guests.

You are responsible for any damage or loss caused by you or your accompanying guests beyond normal wear and tear, including damage to furniture, appliances, walls, floors, and building installations.

In the event of lost keys or access cards, you may be charged the reasonable replacement cost, including any fees that the building administration charges to issue new access media.

You agree to indemnify and hold us harmless from claims by third parties arising from your unlawful or negligent use of the apartment or from breaches of these Terms or the building rules, except where we are at fault.
Our Obligations

We will make the apartment available to you in a clean and functional condition at the agreed check-in date and time and will provide the furnishings and equipment described on our website or in your booking confirmation, subject to minor equivalent changes.

We are responsible for arranging necessary repairs to the apartment and its equipment within a reasonable time after you report a defect, taking into account the nature and urgency of the issue. For larger repairs that depend on third parties (for example, building administration or service technicians), we will coordinate with them as soon as reasonably possible.

We or our local contact persons will be available for reasonable support during your stay, for example in German, English, Cebuano or Tagalog, as indicated on our website. However, we do not  provide 24/7 on-site reception or emergency services.

To the extent permitted by law, our liability is limited to cases of intent and  gross negligence. We are not liable for temporary interruptions of services outside our control, such as electricity, water supply, internet outages, or building facilities, but we will support you in contacting the responsible service providers where appropriate.         
Termination of the Stay

Both you and we may terminate the stay in accordance with these Terms and applicable law.

We may terminate the agreement with immediate effect and ask you to leave the apartment without refund of already due rent if, after a warning where reasonable, you:

  • seriously or repeatedly breach these Terms or the house rules, in particular by smoking in the apartment, bringing pets despite the prohibition, or disturbing other residents;
  • intentionally or recklessly cause significant damage to the apartment, furniture, or building facilities;
  • use the apartment for unlawful purposes or allow unregistered persons to live there contrary to these Terms; or
  • fail to pay the agreed rent or utilities despite a reasonable grace period.

If we terminate for such cause, you remain liable for rent and costs up to the date on which you actually vacate the apartment and hand back all keys and access cards.

You may terminate the stay early in accordance with the cancellation and changes rules above and any additional rights granted to you by mandatory law. In all cases, you must return the apartment, furniture, keys, and access cards in proper condition.
Governing Law and Dispute Resolution

These Terms and any agreement between you and us relating to a long-term stay in the apartment are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules that would lead to the application of another legal system.

We aim to resolve any questions or issues amicably. If you have a concern during your stay, please contact us as early as possible so that we can try to find a practical solution together.

If a dispute cannot be resolved informally, the competent courts at the location of the apartment in the Philippines will generally have jurisdiction, unless mandatory law provides for a different place of jurisdiction.         
Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. An invalid provision will be replaced by a valid one that comes closest to the economic and legal intent of the original provision.

We may update these Terms from time to time, for example to reflect changes in the apartment, building rules, or applicable law. The version in force at the time of  your booking request will generally apply to your stay, unless we expressly agree otherwise with you.
